ATF: Former Border Patrol Agent Busted with Silencer, Meth, Machine Gun Parts

A former U.S. Border Patrol agent faces federal charges after he was arrested in Everett, Wash., for allegedly in possession of homemade silencers and parts to build a machine gun. 

Authorities say they found a Border Patrol badge, several silencers and parts to make a fully automatic AR-15 in a car that was crashed by Shannon Keoni Gaillard, the Seattle Post-Intelligencer reports. 

Authorities also allege that Gaillard, 32, appeared to have been smoking meth and using steroids.

“Gaillard’s possession of this type of ammunition indicates an intent to reduce the sound signature associated with gunshots … to avoid the detection of unlawful firearms use and/or criminal activity,” the agent said in court papers. “This also is consistent with possession of a silencer, which acts to reduce the noise associated with the discharge of a firearm by reducing the sound of rapidly expanding gases which cause loud noises.”

A gunmaker is suing the ATF for claiming the company is selling a gun silencer.

Gunmaker Sig Sauer said that the ATF wrong classified its “muzzle brake” as a silencer.

“If classified as a silencer, no market exists for the subject device given that it will not silence, muffle, or diminish the report of a firearm and yet it would still be subject to the burdensome requirements set forth above as if it really is a silencer,” Sig argues through

Manchester attorney Mark Rouvalis and Virginia attorney Stephen Halbrook.

By classifying it as a silencer, sales will drop significantly because people won’t want to deal with the “required burdens” that come with a silencer.

An El Paso FBI agent is headed off to prison.

John Shipley, now formerly of the FBI, was sentenced Tuesday in El Paso to two years in prison for illegally selling more than $118,000 worth of guns without a license and lying to ATF agents about the sales.

U.S. District Judge David Briones also ordered Shipley to be under supervised release for three years after serving in prison and that he forfeit 17 firearms including two 50 caliber Barrett rifles, ammunition, a silencer and $7,340 seized during the execution of a search warrant, the U.S. Attorney’s Office said.

A federal jury convicted him in April after less than three hour of deliberation. He was busted while working for the FBI and then put on unpaid leave.

ATF agents arrested Shipley last year after tracing back to him a .50 caliber rifle that was used in a drug cartel shootout in Chihuahua, Mexico, authorities said.

“This investigation shows ATF’s commitment into stopping the illegal trafficking of firearms that are fueling the cartel violence south of the border,” Robert Champion, ATF special in charge of the Dallas Division, said in a statement.
