Border Patrol Agent Charged in 2012 Shooting Death of Mexican Teenager

A Border Patrol agent who killed a Mexican teenager in a cross-border shooting was charged with second-degree murder, CBS News reports. 

Lonnie Swartz was indicted by a federal grand jury, an attorney for Jose Antonio Elena Rodriguez’s family said.

“The Elena Rodriguez Family is grateful to the DOJ (Department of Justice) for this first step in the pursuit of justice, and remain steadfast in their resolve to seek full transparency from the U.S. Border Patrol on behalf of Jose Antonio,” Parra said.

Swartz’s attorney said he expects his client to plead not guilty on Oct. 9.

Swartz said his life was in danger when he shot the 16-year-old on Oct. 10, 2012, when he said the teenager was among a group of rock-throwers.

His family said Swartz wasn’t throwing rocks and was walking home from a basketball game when he was shot about 10 times.

It has gotten personal for Jack Riley, the DEA’s No. 2 official.

Riley has put plans of retiring on hold after the prison escape of Joaquin “El Chapo” Guzman, the head of the deadly Sinaloa Cartel in Mexico.

“Just so you now, I was going to retire – until this dick escaped,” Riley told Yahoo News.

Now, he said, “I’m in it for the long haul.”

Riley was one of the targets of Guzman’s murderous trafficking organization.

Guzman escaped from prison three months ago through a mile-long tunnel and hasn’t been seen since.

A Mexican cartel leader convicted of the 1985 torture and murder of DEA Agent Enrique “Kiki” Camarena Salazar could soon be released from prison in Mexico, Fox News reports.

Ernesto “Don Neto” Fonseca Carrillo, 85, who was one of the leaders of the Guadalajara Cartel has served 30 years of a 40-year sentence.

Fonseca Carillo is eligible for house arrest.

The government is considering a proposal by defense attorneys to move Fonseca Carillo to a house, which would be guarded.

Think the Mexico-U.S. border is safer. Think again.

So says Brandon Judd, president of the National Border Patrol Council, who told Congress Wednesday that only 40% of the border is under “operational control,” The Washington Times reports. 

Judd also said that 20% of illegal immigrants who were captured had criminals records.

“This is the challenge we are facing at the border today,” he said. “There are those who will point to lower apprehension rates and tell you the border is secure. Border Patrol agents, however, throughout this nation will tell you the border is not secure, and the southwest border certainly is not safe.”

The assertions contradict claims by President Obama’s administration that conditions at the border are improving.

A Border Patrol agent accused of assaulting a Mexican teenager at a Nogales station in January 2014 won’t be charged, the Tucson News reports. 

A misdemeanor charge was dismissed against Aldo Arteaga on Monday.

The case stems from surveillance video that showed the agent hitting a boy and taking his cell phone.

Since the teen was returned to Mexico just hours after the incident, prosecutors said they had no choice but to dismiss the case because the teen would not be able to attend any court hearings.

Republican presidential candidate Donald Trump said immigrations laws are so lax that Border Patrol agents can’t do their jobs, The Hill reports. 

“People are walking across the border right now, right in front of these great people we have,” Trump told host George Stephanopoulos on ABC’s “This Week.”

“We have wonderful Border Patrol people,” he said. “They can do their job, but they’re not allowed to do the job.”

“People are walking into the country [and] nobody even knows where they come from,” he added. “They walk right past guards that are told not to do anything.”

At times, Trump sounded almost paranoid.

“We have lost control of our country,” he said. “We have lost control of our borders.”

Trump wants to tighten border security, cease birthright citizenship and require Mexico to build a wall at the border.

Border Patrol Finds Drug Smuggler in Scuba Gear Near Long Tunnel to Mexico

When Border Patrol agents found a man in scuba gear, they knew something odd was afoot.

Turns out, the man was smuggling drugs through a tunnel that was partially underwater at the end of the All-American Canal, about 7 miles east of Calexico, Calif., The Associated Press reports.

Near the man was a breathing tank and several vacuum-sealed packages containing 55 pounds of cocaine.

The April 25 discovery unearthed a 150-foot-long tunnel that stretched from the canal to a house in Mexicali, Mexico.

“Drug smugglers will try anything to move their product — even scuba diving in an underwater tunnel,” U.S. Attorney Laura Duffy said in a statement. “The ingenuity of the smugglers is matched only by our determination to thwart it.”

GOP presidential hopeful Donald Trump wants to seal off the border.

But U.S. Customs and Border Protection Commissioner R. Gil Kerlikowske says it’s not possible to keep everyone out of the U.S.

“You’re certainly not going to have a border as long as we have with the government of Mexico that is going to not ever have anyone cross illegally,” Kerlikowske said Tuesday while visiting the San Ysidro Port Of Entry south of San Diego, according to a report by the TV station 7 San Diego.
