Wall Street Journal: FBI’s Handling of Clinton Investigation Looks Like Political Favoritism

The closer we look at the FBI’s investigative file on Hillary Clinton’s emails, the more we wonder if Director James Comey always intended to let her off the hook. The calculated release before the long Labor Day weekend suggests political favoritism, and the report shows the FBI didn’t pursue evidence of potential false statements, obstruction of justice and destruction of evidence.

Mr. Comey’s concessions start with his decision not to interview Mrs. Clinton until the end of his investigation, a mere three days before he announced his conclusions. Regular FBI practice is to get a subject on the record early then see if his story meshes with what agents find. In this case they accepted Mrs. Clinton’s I-don’t-recall defenses after the fact.

The notes also show the G-men never did grill Mrs. Clinton on her “intent” in setting up her server. Instead they bought her explanation that it was for personal convenience. This helped Mr. Comey avoid concluding that her purpose was to evade statutes like the Federal Records Act. Mr. Comey also told Congress that indicting her without criminal intent would pose a constitutional problem. But Congress has written many laws that don’t require criminal intent, and negligent homicide (for example) has never been unconstitutional.

The FBI notes also blow past evidence that Clinton advisers may have engaged in a cover-up. Consider page 10 of the FBI report: “Clinton’s immediate aides, to include [Huma] Abedin, [Cheryl] Mills, Jacob Sullivan, and [redacted] told the FBI they were unaware of the existence of the private server until after Clinton’s tenure at State or when it became public knowledge.”

That’s amazing given that Ms. Abedin had her own email account on the private server. It is also contradicted by page 3: “At the recommendation of Huma Abedin, Clinton’s long-time aide and later Deputy Chief of Staff at State, in or around fall 2008, [ Bill Clintonaide Justin] Cooper contacted Bryan Pagliano . . . to build the new server system and to assist Cooper with the administration of the new server system.”

Putin: Hacking of DNC Emails Was Public Service But Denies Government Responsible

Vladimir Putin denied accusations that Russia’s government hacked thousands of Democratic National Committee emails and documents, but said the action was a public service.

“Listen, does it even matter who hacked this data?’’ Putin said in an interview with Bloomberg at the Pacific port city of Vladivostok on Thursday. “The important thing is the content that was given to the public.’’

Putin has long been a critic of Hillary Clinton, who compared his annexation of Crimea in 2014 to Adolph Hitler’s actions before WWII.

“There’s no need to distract the public’s attention from the essence of the problem by raising some minor issues connected with the search for who did it,” Putin said of the DNC breach. “But I want to tell you again, I don’t know anything about it, and on a state level Russia has never done this.”

Bloomberg reports:

The Federal Bureau of Investigation has high confidence that the government in Moscow was behind the theft at the DNC and other Democratic Party organizations seeking to propel Clinton to victory over Republican Donald Trump in November, a person familiar with the findings has said. Trump has praised Putin as a great leader and the billionaire’s former campaign chairman spent years working for the Kremlin ally who was ousted from Ukraine’s presidency in 2014.

FBI Delivers Secret Clinton E-mail Records to Congress

The FBI on Tuesday delivered to Congress classified records from the federal investigation into Hillary Clinton’s use of a private email server while she was secretary of state.

Included in the records was a FBI summary of the 3.5-hour interview with Clinton at FBI headquarters early last month, Politico reports.

The materials were handed over to the House Oversight and Government Reform Committee.

“The FBI has turned over a ‘number of documents’ related to their investigation of former Secretary Clinton’s use of a personal email server. Committee staff is currently reviewing the information that is classified SECRET. There are no further details at this time,” a spokesperson for the House Oversight Committee said on Tuesday afternoon.

Fear of Espionage Prompted FBI to Investigate Clinton’s Use of Emails

The FBI investigation into Hillary Clinton’s use of a private e-mail server while she as secretary of state was prompted by fears of espionage.

Vice News obtained two secret letters the FBI sent to the State Department that revealed why an investigation was launched.

The Intelligence Community’s Inspector General feared that Clinton’s e-mails may have been “compromised” and shared with a “foreign power or an agent of a foreign power.”

A Section 811 referral “arises whenever there is a compromise of classified information — for whatever reason,” said Steven Aftergood, director of the Project on Government Secrecy at the Federation of American Scientists. “It could include espionage, but it could also include negligence, inadvertence, or something else…. Section 811 does not assert a violation of criminal law.”
FBI Director James Comey said last month that the bureau uncovered no “direct evidence” that Clinton’s server “was successfully hacked.”

Politifact: Hillary Clinton Incorrectly Said FBI Agreed She Was Truthful to Public

Hillary Clinton’s claim that FBI Director James Comey agreed that she was truthful to the public about classified emails is “incorrect,” reports Politifact.com. 

Clinton made the comment in an interview with Fox News Sunday.

“Clinton appear to have selective hearing,” Politifact concluded.

In fact, when Comey was asked during a congressional hearing whether Hillary lied to the public, the director responded, “That’s not a question I’m qualified to answer.”

Comey added that he hadn’t analyzed her public comments.

When Comey announced the FBI’s findings July 5, it was clear that there are obvious inconsistencies between what Clinton said publicly about classified information on her private email server before her FBI interview and what the FBI found. Pointedly, Clinton said there wasn’t any classified information in her email, and he said there was.

Clinton Claims FBI Director Said Her Comments ‘Were Truthful’

Hillary Clinton claimed Sunday that FBI Director James Comey concluded her statements about using private email “were truthful.”

Clinton made the claim on “Fox News Sunday” after host Chris Wallace challenged her, showing previous comments she had made about the investigation.

Wallace pointed out that Clinton said she did not use the server to send classified material.

“After a long investigation, FBI Director James Comey said none of those things that you told the American public were true,” Wallace said.

Clinton responded, “Director Comey said that my answers were truthful and what I’ve said is consistent with what I have told the American people, that there were decisions discussed and made to classify retroactively certain of the emails.”

She added: “I was communicating with over 300 people in my emailing. They certainly did not believe and had no reason to believe that what they were sending was classified. Now, in retrospect, different agencies come in and say, ‘Well, it should have been.” But that’s not what was happening in real time.'”

Clinton Campaign Declined FBI Help After Hacking Was Suspected

The FBI first warned Hillary Clinton’s campaign last year that its networks likely were hacked, but the campaign wouldn’t give federal investigators access to the internal data.

A Clinton aide said the FBI did not reveal that Russian intelligence agencies were suspected of being behind the hack attempt, NBC News reports. But the aide said that the campaign was aware of hacking attempts and was taking steps to make the networks more secure.

Shortly after, the Democratic National Committee hired Crowdstrike to investigate a potential breach. The cyber security firm determined that two Russian intelligence agencies were responsible for hacking into the DNC.

Secret Service Investigating Trump Adviser for Calling on Execution of Clinton

The rhetoric coming from the Donald Trump campaign has gone from divisive to potentially illegal.

The Secret Service said Wednesday it’s investigating New Hampshire state Sen. Al Baldasaro for calling on a fire squad to execute Hillary Clinton for using a private e-mail server, NBC News reports.

“The U.S. Secret Service is aware of this matter and will conduct the appropriate investigation,” Secret Service spokesman Robert Hoback told NBC News in a statement Wednesday.

Baldasaro made the comments on the Jeff Kuhner radio show.

Beldasaro is an adviser for veteran’s issues for the Trump campaign.
