Looks like the U.S. Court of Appeals agrees with federal prosecutors that some members of the Christian militia called the Hutaree are too dangerous to be set free pending trial.

The federal appeals court ruled Tuesday that the leader of the Michigan-based group David Stone Sr. and four other members should stay behind bars for now, the Detroit News reported.

“We find that each defendant poses a danger to the community and that no conditions of release will reasonably assure the safety of the community,” the appeals court said, according to the Detroit News.

U.S. District Judge Victoria A. Roberts had ruled earlier that the members could be released on home detention, the News reported. Federal prosecutors had earlier agreed to let four other defendants in the case  go free pending trial.
