Capitol Police Officer Speaks Out about Fatal Shooting of Ashli Babbitt

The Capitol police officer who shot and killed Ashli Babbitt during the Jan. 6 siege said he pulled the trigger to “save the lives of members of Congress and myself and my fellow officers.”

For the first time, Lt. Michael Byrd spoke publicly about the Capitol attack and his reasons for firing his weapon during an interview with NBC News’ Lester Holt on Thursday night. 

Byrd, a 35-year-old Air Force veteran, said he’s been threatened, and some of the attacks have been racist. 

“They talked about killing me, cutting off my head,” Byrd said. “It’s all disheartening, because I know I was doing my job.”

The interview comes several days after an internal investigation cleared Byrd of wrongdoing, saying he followed department policy, which allows deadly force when there’s a reasonable expectation of serious physical harm to themselves or others. 

“If they get through that door, they’re into the House chamber and upon the members of Congress,” Byrd told NBC, saying Babbitt had been “posing a threat to the United States House of Representatives.” 

Byrd said he saved lives: “I know members of Congress, as well as my fellow officers and staff, were in jeopardy and in serious danger. And that’s my job.”

Also on Thursday, seven other Capitol police officers filed a lawsuit against former President Trump and others, including right-wing extremists groups, accusing them of conspiring to promote groundless claims of widespread fraud that fueled the riot.

Secret Service Warned of Potential for Violence a Day Before Jan. 6 Riot

The Secret Service warned the U.S. Capitol Police about the potential for violence on Jan. 5, a day before Trump supporters stormed the Capitol building, according to new documents obtained by POLITICO.

It’s just the latest lapse in intelligence by the Capitol Police and other federal law enforcement agencies that failed act on credible warnings.

On Jan. 5, the Secret Service emailed a tip issued by a “concerned citizen” at the Denver Field Office about people who were headed to Washington D.C. to “attend tomorrow’s rally and ‘incite violence.’”

The email was obtained by the watchdog group Citizens of Responsibility and Ethics in Washington via a Freedom of Information Act request.

“Per our Denver Field Office, a concerned citizen reported that [REDACTED] were flying into BWI today to attend tomorrow’s rally and ‘incite violence,’” the email states. “In addition, the source reports that [REDACTED] previously made threats against President-Elect Biden. The source also reported that [REDACTED] was driving to DC with gear and weapons, to include ballistic helmets, armored gloves and vests, rifles, and suppressors.”

The email referred to the travelers’ motives, saying they were “in the area to protest election fraud, support President Trump.”

Included in the email was a screenshot of a Facebook post from one of the people attending the rally.

“We have an opportunity in Front of us to take back our country and abolish the deep state once and for all,” the post says. “Call me some right wing conspiracy theorist if you will I don’t give a [f—] I read the Facts and I study history.”

Another email from the Secret Service warned of “multiple threatening Parler Posts directed at DC Police.”

“While the subject appears to be targeting MPDC, the subject calls for violence against any law enforcement in DC that ‘sides with the enemy,’” the Secret Service email states.

Despite this and other warnings, the Capitol Police were unprepared for the violence that broke out on Jan. 6, which resulted in the injuries of dozens of Capitol Police officers.

In a statement, the Capitol Police said it had received no intelligence to suggest “a large-scale attack.”

Ex-FBI Deputy Director McCabe Lambasts Trump for ‘Threatening Law Enforcement’

Former FBI Deputy Director Andrew McCabe accused former President Trump of “threatening law enforcement” after he demanded “justice” against the Capitol Police officer who fatally shot Ashli Babbitt during the Jan. 6 riot. 

In an interview on CNN’s “The Situation Room,” McCabe called Trump’s remarks “incredibly dangerous.”

“We know this for a fact. It is not something we are theorizing about,” he said. “We have seen before the impact that the president’s words have on his most die-hard and emotional supporters.”

McCabe cited examples of Trump’s rhetoric leading to violence.  

“We have seen an attempted bombing plot by a domestic extremist who was arrested some years ago who said he was following the directions of President Trump,” he said. “We all saw the insurrectionists on January 6th acting what many of them had said, they thought they were following his direction.”

In a statement last week, Trump suggested Babbitt, who stormed the Capitol with other insurrectionists, was a patriot. 

“I spoke to the wonderful mother and husband of Ashli Babbitt, who was murdered at the hands of someone who should have never pulled the trigger of his gun,” Trump said. “We know who he is. If this happened to the ‘other side,’ there would be riots all over America, and yet there are far more people represented by Ashli, who truly loved America, than there are on the other side.”

Trump continued, “The Radical Left haters cannot be allowed to get away with this. There must be justice!”

McCabe explained how Trump’s remarks were dangerous. 

“Let’s face it,” he said. “When he says ‘we know who you are,’ that’s a threat. That’s the same sort of language that a mob boss or a drug kingpin would use to threaten a subordinate.”

McCabe added, “You have the former president of the United States threatening members of law enforcement. It’s just outrageous.”

FBI Tipped Off Capitol Police about Potential for Violence at U.S. Capitol

The FBI warned U.S. Capitol Police about the potential for violence in Washington D.C. on Jan 6 and even visited more than a dozen extremists to encourage them not to attend the planned protest, NBC News reports.

The FBI and NYPD also passed on information to Capitol Police about the risk of violence as lawmakers planned to vote on the Electoral College. 

The report contradicts statements from some several law enforcement officials who claimed there was no evidence that protests would turn violent. 

Steven D’Antuono, head of the FBI’s Washington Field Office, said last week that “there was no indication that there was anything (planned) other than First Amendment-protected activity.”

Despite the warnings, Capitol Police were overwhelmed by violent Trump supporters who forced their way into the building. At least five people were killed, including a police officer. 

Now the FBI is asking for the public’s help tracking down rioters.

Congressman to the Rescue: Sidewalks too Hot For Fed Dogs

CAPITOL Police dogs should soon be barking their gratitude to U.S. Rep. Bob Brady. Brady recently noticed that some of the bomb-sniffing dogs that inspect cars at the entrance to the Capitol were limping and was told it’s because of the hot pavement.

So Brady has arranged for the asphalt where the dogs work to be painted white.

The white paint is said to be 20 to 25 degrees cooler than blacktop, and Brady says the CIA, FBI, and Secret Service headquarters all have white paint to help their search dogs.

Brady says the painting will be done Saturday. He offered to provide paint, but the Capitol Police turned him down.

“The dogs are getting hurt and they can’t do their jobs. It’s hard to concentrate on smelling a bomb if their feet are burning,” Brady told us.
