Appeals Court: Different Standards for FBI Fitness Test Is Not Discrimination

The FBI’s physical fitness test has different standards for men and women. Men, for example, must do more than twice the number of push-ups as women.

The U.S. Court of Appeals for the 4th Circuit dismissed a challenge to the test by a man who was turned down to become special agent because he could only do 29 of the required 30 push-ups, The Washington Post reports. 

Jay J. Bauer filed a discrimination suit, saying he was held to a different standard than women.

But the appeals court said that’s not necessarily a problem because the “physical fitness standards suitable for men may not always be suitable for women, and accommodations addressing physiological differences between the sexes are not necessarily unlawful.”

Women are required to perform 14 push-ups.

Donald Trump Urges FBI to Pursue Charges Against Clinton, Saying He’d Rather Face Bernie Sanders

Donald Trump is urging the FBI to aggressively pursue charges against Hillary Clinton for using a private email server while she was secretary of state, saying he would rather run against Bernie Sanders, Politico reports. 

“There is no answer to what she did. You know the amazing thing, other than greed, there was no — what’s she doing?” Trump asked. “You just use what you’re supposed to use, and you assume people are listening. Who the hell cares? And then you do what you have to do. All this for what? It’s greed. It’s really just greed in its own way. All she had to do was just do what she was supposed to do.”

Trump said he’d “love to run against Bernie,” calling Sanders a coward after he allowed Black Lives Matters protesters to steal the stage from him in Seattle in August.

“He walked back like a little puppy. This is gonna be our president,” Trump said. “I would love—please FBI, please go after Hillary. I wanna run against Bernie!”

Venezuela’s First Lady Accuses DEA of Kidnapping Nephews in Drug Arrest

Venezuela’s first lady said the arrest of her two nephews on drug trafficking charges amounts to kidnapping by the DEA, the Associated Press reports. 

Cilia Flores claims that the U.S. was motivated by revenge and are trying to purge socialists from power.

Flores said the DEA’s operations on Venezuelan soil “violated our sovereignty.”

The DEA arrested two of Flores’ nephews in Haiti in November, and they were charged with conspiring to smuggle cocaine into the U.S.

“The DEA committed the crime of kidnapping,” Flores said.

The Capture of ‘El Chapo’ Elevates Columbian Woman to World’s Most Wanted Drug Lord

Now that notorious drug boss Joaquin “El Chapo” Guzman has been captured in Mexico, the world’s most wanted drug lord is now a woman from Columbia, HNGN reports. 

Largely unknown, Maria Teresa Osorio de Serna is wanted for drug conspiracy charges and money laundering.

Although she has no criminal record, the woman is suspected of laundering millions of dollars from the notorious Medellin Cartel.

FBI Joins Philadelphia Police to Investigate Possible New Threats Against Officers

Just days after an ISIS supporter ambushed Philadelphia Police Officer Jesse Hartnett, a disturbing tip suggests a possible new threat against the city’s cops, CBS Philly reports. 

The FBI has joined police to investigate the possibility of new attacks.

Police are trying to determine whether Edward Archer was part of a wider threat against police after he shot the 33-year-old officer inside his patrol car.

“I just got off the phone with the agent in charge of the FBI and he gave me an update that’s pretty much status quo, but they are looking to put their hands on some folks just to talk to them,” Police Commissioner Richard Ross told Eyewitness News.

An anonymous informant warned that the “threat is not over” and that Archer was “part of a group of three others and is not the most radical of the four.”

Officers have been ordered to drive with a partner.

“We have to do it, in light of the information we received yesterday. We’d be remiss if we didn’t look at that. We still don’t know if there is anything more involved,” the commissioner said.

Federal authorities said actor Sean Penn’s secret meeting with notorious drug lord Joaquin “El Chapo” Guzman set the stage for capturing the fugitive.

But did Penn break the law by interviewing Guzman?

Penn met with Guzman while an international manhunt was underway for Guzman.

Penn said he used burner phones and other methods to dodge detection.

But it’s not illegally to meet with someone who is a fugitive from justice, BBC reports, citing law enforcement experts.

“Simply having contact with a known narco-trafficker is not the basis of prosecution,” said Daniel Richman, a professor of law at Columbia University and a former federal prosecutor.

What’s illegal is to help a fugitive avoid capture or to interfere with the manhunt.

“There don’t seem to be signs that Mr Penn is guilty of that, or that authorities in the US or Mexico will file criminal charges against him,” BBC wrote.

A Secret Service agent who was severely injured in a car crash in New Hampshire last month didn’t let his injuries stop him from getting married.

The New York Post reports that Garrett FitzGerald, who can’t stand on his own, because of a spinal cord injury, tied the knot Saturday at Massachusetts General Hospital.

FitzGerald, who was part of Hillary Clinton’s protective detail when the crash occurred, was one of four Secret Service agents involved in a car crash on Dec. 29 in Wakefield, New Hampshire.

A GoFundMe page also was created to help raise funds for FitzGerald.

FBI Expands Investigation of Hillary Clinton Over Her Public Charity

The FBI is expanding its investigation of Hillary Clinton to determine whether her use of a private email account amounted to public corruption, Fox News reports.

The FBI has been focusing on the mishandling of classified information, but three intelligence sources said the investigation now includes whether there’s an “intersection” between the Clinton Foundation work and State Department business.

“The agents are investigating the possible intersection of Clinton Foundation donations, the dispensation of State Department contracts and whether regular processes were followed,” one source said.

Clinton said she was not aware of an expanded investigation.

The Clinton Foundation, a public charity that raised $144 million in 2013, may have benefited from her work when she was secretary of state, the sources said.

“Many previous public corruption cases have been made and successfully prosecuted with much less evidence than what is emerging in this investigation,” an intelligence source told Fox News.
