ACLU Lashes Out at FBI for Refusing to Release Details of Warrantless GPS Spying

Steve Neavling

The ACLU is incensed that the FBI won’t hand over details of how agents have used warrantless GPS trackers on cars to monitor suspects, reports.

Responding to a request for public information, the FBI redacted virtually every word from the records, saying the information is privileged, reports.

The ACLU wants to see other tracking methods used by federal agents following a Supreme Court ruling that determined GPS trackers require a search warrant. The group also wants to know how the FBI plans to retrieve GPS trackers already on cars.

“The Justice Department’s unfortunate decision leaves Americans with no clear understanding of when we will be subjected to tracking—possibly for months at a time—or whether the government will first get a warrant,” wrote Catherine Crump, an ACLU staff attorney.

Editorial: Immigration Reform Heads in More Sensible Direction

Deseret News

Utah is deporting fewer people, and that’s a good thing.

In 2012, requests for deportation were down by 25 percent from 2011, and current trends predict a similar downturn this year. Scarce resources in the judicial system account for some of this, but there are other factors at work that suggest a more pragmatic approach to immigration going forward.

It’s worth noting that one of the reasons fewer people are being deported is that there are fewer illegal immigrants to deport. The vast majority of people who enter the country illegally are doing so to improve their personal circumstances, and the wobbly recovery has dried up the economic incentives that enticed border crossers in years past. Our immigration system ought to include avenues to accommodate those who want to cross our borders simply to seek a better life. Harsh remedies like deportation ought to be reserved for those who enter the country illegally with more nefarious purposes in mind.

Just Paranoid or For Real? Ex-D.C. Mayor Marion Barry Says the FBI Tried Killing Him

Marion Barry/gov photo

By Allan Lengel

Marion Barry, the former D.C. mayor who know sits on the city council, is unquestionably an interesting character.

Now add this:

U.S. News reports that Barry said he believes the FBI tried killing him on Jan. 18, 1990, when he was arrested for crack cocaine possession in a sting operation in which Barry was caught smoking crack in a hotel room with his ex-girlfriend Rasheeda Moore.

“The FBI had a mind to entrap me, also the FBI tried to kill me by having some substance that wasn’t proven to be crack,” Barry told U.S. News in a phone interview.

“They had an EMT on the spot, which is not only unusual but rare in history of the FBI,” Barry noted as he offered evidence to support his claim that the FBI attempted to kill him. “Why would they have an EMT on the scene if they weren’t trying?”

Mexican Man Says He Lied About Killing Border Agent Brian Terry

Brian Terry

ABC News

A Mexican man who says he killed U.S. Border Patrol Agent Brian Terry fabricated his claim to gain attention, the Federal Bureau of Investigation (FBI) said Friday.

The FBI said in a statement that agents interviewed Gustavo Cruz-Lozano in San Antonio on Thursday after he claimed to have killed Terry during an interview with Univision News.

“During the course of the interview, Cruz-Lozano admitted to the agents that he lied about his involvement in the death of U.S. Border Patrol Agent Brian Terry in order to garner attention,” Special Agent in Charge James L. Turgal, Jr. said in the statement.

FBI Lays Out What It Wants for New Headquarters

By Jonathan O’Connell
Washington Post

It was 35 minutes past the scheduled start time when everyone had finally made their way through the security and Dan Tangherlini, acting administrator of the General Services Administration, took the podium.

He assumed by the size of the crowd — an estimated 350 people, some of them watching on a screen in an overflow room — that there was a lot of interest in building a new headquarters for the Federal Bureau of Investigation. “I think that bodes pretty well for this project,” he said.

Six weeks after issuing a broad search for ideas of how and where to build a consolidated headquarters for the FBI, developers, Tangherlini and his staff reiterated why they wished to swap the J. Edgar Hoover building property on Pennsylvania Avenue for a new consolidated FBI headquarters: the Hoover building is obsolete and the government has limited capital to build a replacement.

FBI Agent Tells of Sex in the Philippines But Says he Didn’t Pay for It

By Hailey Branson-Potts
Los Angeles Times

LOS ANGELES — A day after meeting a pretty young woman working at a karaoke club in the Philippines, Marc Napolitano started getting text messages from her, he said.

The woman, named Maui, wrote that she missed him, loved him and wanted to see him. Within days of their first meeting, Maui went to Napolitano’s hotel room, where they had sex, he said.

The room was paid for by American taxpayers, he said. So was the cellphone on which he got her messages, and so were the trips that took him to the Philippines.

Napolitano, an FBI agent, traveled to Manila several times in 2010 and 2011 while working on cases involving weapons trafficking from the Philippines to the United States. He was posing as a club patron while providing security for another undercover FBI agent.

On Friday, he testified in a federal courtroom in downtown Los Angeles as part of a defense motion seeking to throw out criminal charges against three Filipino nationals charged with weapons smuggling.
