Paula Broadwell, whose affair with then-CIA Director David Petraeus led to his resignation, won’t be charged with cyberstalking, NBC News reports.

“The United States Attorney’s Office for the Middle District of Florida has decided not to pursue a federal case regarding the alleged acts of ‘cyber-stalking’ involving Paula Broadwell,” a spokesman for the office said Tuesday in a written statement.

Broadwell, the 37-year-old who wrote a biography about Petraeus, is accused of sending harassing emails to women who were close to Petraeus.

The decision not to prosecute was made “after applying relevant case law to the particular facts of this case,” the U.S. Attorney’s Office statement said.

“The decision on whether to bring a prosecution is always a serious matter, and one that should never be undertaken without the most thoughtful deliberation. As federal prosecutors, we are guided in the discharge of our responsibilities by considerations of fairness and justice. The prosecution of a case is undertaken only after the most careful review and analysis of the evidence and applicable law,” the statement said.

The FBI agent whose investigation brought down CIA Director David Petraeus played a major role in foiling a terrorist attack.

The USA Today reports that Special Agent Frederick Humphries II helped stop a terrorist plot to blow up Los Angeles International Airport in 2000.

Humphries also fatally shot a knife-wielding man at Tampa’s MacDill Air Force Base in 2010, the USA Today reported.

Now Humphries is credited with kickstarting the Petraeus investigation after he first saw threatening emails from the CIA director’s biographer, Paula Broadwell.

The FBI is under fire for not immediately disclosing the extramarital affair of ex-CIA Director David H. Petraeus to the White House and Congress, Bloomberg News reports.

Saying the affair “could have had an effect on national security,” California Sen. Dianne Feinstein said the investigation should have been revealed more quickly.

The investigation began in the summer when the FBI last week notified U.S. Director of National Intelligence James Clapper, who alerted the White House, the Atlanta Journal-Constitution reported.

According to the Boston Globe this morning, the FBI downplayed the impact on national security and said it was wary of revealing an investigation that hadn’t appeared to involve criminal wrongdoing by Petraeus.

The investigation was triggered by threatening e-mails to a woman, a friend of Petraeus and his wife.

The e-mails were sent by Paula Broadwell, 40, the author of Petraeus biography, Bloomberg News wrote.
